What Is A Capital Sentence?

Laws are written and approved by political leaders for the purpose of controlling the actions of citizens. Certain actions are defined as being outside the law, or illegal. When an individual engages in activity that is specifically defined as illegal, law enforcement officers are authorized to arrest this person and hold him for trial or until a judge or jury determines what the next step will be.

Punishment for illegal activity can vary from a stern warning or small fine to incarceration in jail or even to taking the criminal’s life. This latter step is known by the common term of capital punishment or death penalty. There are two distinct sides to the capital punishment issue, as one group is adamantly opposed to taking a life as punishment for a crime and another group emphasizes that the death penalty is proper punishment for certain crimes.

capital-sentenceOne of the arguments made for using the death penalty is that the example set by putting the offender to death will deter others from committing the same crime. In addition, the act of putting this offender to death permanently removes the individual from society, eliminating the possibility that he or she will commit the same act again. Thus, say capital sentence supporters, society is safer without this person in it.

Opponents of capital punishment believe the sentence is extreme and should be used sparingly if at all. Some have used the language of the Constitution to argue against capital sentences, saying the death penalty is “cruel and unusual punishment.”

Murder is, of course, well known as a capital crime – a crime that brings with it the possibility of a capital sentence. Some courts rule that a few specific violent crimes that don’t result in the death of the victim may also be punishable by a capital sentence. For example, sex crime sentencing may include the possibility of the death sentence. In some countries the act of adultery is punishable by death.

At the heart of the capital punishment issue is the question of violating someone’s human rights, especially if the crime is not excessively violent or does not end in the death of the victim. Many comprehensive studies have been conducted to try to determine the effect a capital sentence has on society. One study followed prisoners who were placed on “death row” since 1973 to await execution.

Other studies and stories have been researched and written to try and learn what effect a particular death-penalty crime has on the individual who committed it. Some have said that the treatment of the prisoner and the expectation of a capital sentence actually push the individual toward more crime.

These opponents of the use of a capital sentence believe that the criminal is less likely to commit another violent crime than supporters of the death penalty would have us believe.There are a few cases in which the supporters of the death penalty and the opponents of the death penalty have come to agree. When the situation involves a repeat murderer or a serial killer, there is some agreement on the use of the capital sentence.
